You must be legally capable of entering into a binding agreement to use HypeSpike. By using the platform, you represent that you meet this requirement and that any information you provide is accurate and current.

3. Accounts

You are responsible for maintaining the security of your account and credentials. You are also responsible for activity that occurs under your account. We may suspend or restrict access if we believe an account is being misused or used in violation of these terms.

4. Ownership of Content

You retain ownership of content you upload, link, edit, or generate using materials you have the right to use. HypeSpike does not claim ownership of your original streams, videos, or resulting clips. You are responsible for ensuring you have the rights and permissions necessary for any content you submit.

5. License to Operate the Service

By using HypeSpike, you grant us a limited license to host, process, transmit, and display your content solely as necessary to operate, improve, and provide the service to you.

6. Promotional Use

By using our editing and generation features, you acknowledge that HypeSpike may use selected highlights or outputs for promotional purposes such as demos, case studies, social posts, or marketing materials. You may request removal by contacting us at support@hypespike.io.

7. Acceptable Use

You may not use HypeSpike to violate any law, infringe copyright or other rights, submit harmful or malicious material, interfere with the platform, abuse system resources, scrape or reverse engineer the service, or harass or harm others. Violations may result in suspension, termination, or legal action.

8. User Responsibility

You are solely responsible for how you use content generated by HypeSpike, including how you publish, monetize, distribute, or represent that content. HypeSpike does not verify that your use of third-party media complies with platform rules, copyright law, sponsorship obligations, or contract restrictions.

9. Subscriptions, Credits, and Payments

HypeSpike may offer free plans, paid subscriptions, usage-based credits, promotional offers, or trial access. Pricing, included features, usage limits, and billing terms may change from time to time. Unless otherwise stated, fees are non-refundable once paid, except where required by law.

10. Plan Changes and Cancellation

We may modify, replace, or discontinue plans, features, or pricing at any time. If you are on a paid plan, changes will apply in accordance with your billing cycle unless otherwise stated. You are responsible for cancelling your subscription if you no longer wish to continue using a paid plan.

We aim to provide a reliable platform, but we do not guarantee uninterrupted availability, perfect accuracy, or that every clip generation or edit will work as expected. Features may change, break, or be removed over time.

HypeSpike is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all warranties, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

13. Limitation of Liability

To the fullest extent permitted by law, HypeSpike and its affiliates, officers, employees, and partners will not be liable for indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunity arising from your use of the platform.

14. Indemnity

You agree to defend, indemnify, and hold harmless HypeSpike and its affiliates, team members, and service providers from claims, liabilities, damages, losses, and expenses arising out of your content, your use of the service, or your violation of these terms.

15. Termination

We may suspend or terminate your access to HypeSpike at any time if we believe you have violated these terms, created risk for the platform, or used the service in a way that could harm us or others.

We may update these Terms of Service from time to time. When we do, the updated version will be posted on this page and will apply from the time of posting unless otherwise stated.

17. Governing Principles
